Urgent Travel to India - H1b Transfer Pending

Hi Everyone,

 

I have seen this question on multiple posts; however could not find the exact situation I am in. Your help is appreciated.

 

I have recently changed my employer from A to B. My visa with employer A has expired and H1B transfer with employer B is in process. I need to travel to India on Oct 2nd. We upgraded H1b transfer to premium 2 weeks back and now we got a RFE. Employer B mentioned that they may need some time to respond to the RFE and we may not get approval by oct 2nd.

 

Is it still okay to travel and be in India until I get my approval from Employer B. I am hoping that my employer will get it sorted out before I leave India on Oct 30th and we may have approval by that time.

 

I am planning to travel back to USA only after getting H1b visa extension. However would like to understand if it is okay to leave the USA while my transfer is in progress.

Yes it is fine as you know that you can enter only after approval with a valid H1B visa.

I am also in the same boat as you are. I have my flight on October 14 and my H1B extension is pending with RFE in premium processing. My employer said they submitted the documents on October 2, but I don't see any update on my case so far. I just have only 3 days left for my travel and getting tensed as I don't know whether I can travel at this time or not. 

 

Is it okay to travel to India while the H1B extension is pending in RFE in PP? My current H1 is expired on 1st week of September. Will there be any issues to my extension application If I travel outside US? I am going for 1 month vacation and I can go for stamping after I receive the approval. But Is it ok to travel in this situation? Do USCIS ask any questions if i leave the country while the application is pending in RFE?

Do you have any issues at Immigration while leaving the country? Did you get your H1B approved? I am in the same boat as you are and waiting for my extension approval which received RFE. I applied in PP and RFE documents are submitted on 10/02, but no update on my petition yet. My flight is on October 14th. Thanks for your help!
