My priority date has become current now and I am eligible to file I-485. For some reason, my employer is delaying in giving a green signal to the attorney to file my I-485. Questions: 1. In case my employer decides not to proceed further with my GC for whatever reason, what would be my status? 2. Would my H1b visa become invalid or out of status immediately? 3. I missed to mention that I have already extended my H1b beyond 6 years. Do your answers still stand good in this case? Since the basis for still extending my H1b is the ongoing GC process, would my current visa be valid if GC process is discontinued? If so, I am assuming that it won't extended further after the current H1b validity expires. Please correct me and clarify if I am wrong. Thank you. Link to comment
