vishnu13 Posted September 15, 2015 Report Posted September 15, 2015 Hi All, I have been following this blog for quite sometime and posts on blog are really helpful. After I came to US filed L2 EAD. Now 76 days over but status on USCIS website shows as "CASE RECEIVED" which is making nervous and worry. Spoke to USCIS customer care executive recently, raised service request. If anyone can help with suggestions or leads it would definitely lift my spirits up. I am providing few details of my case, July 01 2015 -- Application received by USCIS on July 01 2015 (Docs sent to Phoenix AZ June 26 2015) July 06 2015 -- Received 'Notice of Action' from USCIS -- I-797C and given address as California Service center to contact for any queries. Current status --- " we received your Form I-765, Application for Employment Authorization...." So from 76 days no update in status. thanks
TTN Posted September 18, 2015 Report Posted September 18, 2015 Hi vishnu13, You have to wait until 90 days to pass to take an Infopass appointment. This might help to expedite your case. If it still does not work out try writing to CIS Ombudsman with details of your case. Just my opinion and not Legal advice. Thanks, TTN *** This is what USCIS replied regarding EAD Issuance to CIS Ombudsman *** To accomplish EAD issuance within 90 days as required by regulation, USCIS is taking a multi-faceted approach. First, we will continue to conduct routine sweeps of our systems to determine Form I-765 applications which have been pending for at least 60 days and have not been assigned to an Immigration Officer (IO). These sweeps are conducted at least weekly and more frequently if necessary. Applications that have not been assigned will be forwarded to an IO to facilitate adjudication within the required timeframe. We also have updated customer call scripts at the NCSC to state that service requests can be accepted when an EAD application has been pending for at least 75 days. Service requests accepted by the NCSC will be forwarded to the Service Centers and the National Benefits Center (NBC). The Service Centers and the NBC will be required to prioritize these cases and have them adjudicated prior to the 90th day. We will also issue guidance to the Service Centers, the NBC, and Field Offices regarding requests on EAD applications that have not been adjudicated within 90 days. Applicants who have not received a decision on their Form I-765 application after 90 days can call the NCSC to request expedited processing or go to their local office via an InfoPass appointment.

Filed on July 10 2015 Received Notice of Action July 15 2015 Current Status: CASE RECEIVED Not sure how to proceed further. I will wait for some time before proceeding further. thanks
