I have exhausted my 5 year limit of L1B and am currently outside the US working at the offshore office for the same company. My Perm was approved recently and the I-140 will be filed soon. Assuming that there will always be a lottery system for the H1 visa, I do not want to rely only on that. Once my I-140 is approved, can I file for an H1 visa separately with USCIS outside the cap of 65000 or do I need to apply within the quota itself? Thanks!
