jamesthomas Posted September 14, 2015 Report Posted September 14, 2015 Hi I came to USA on H4 visa in the month of April. In July I filed for F1 status conversion. I have not received any update from USCIS until now regarding my change of status. My wife is asking me for a divorce now as she is on her H1b now. If i file for a Divorce now will i be legally out of status even though my case is still pending in USCIS. I got married in the state of Pennsylvania. What are my options now to be in status. Can you please help me out as my situations is very crucial now. Thanks.
jairichi Posted September 14, 2015 Report Posted September 14, 2015 The moment your divorce is finalized you can no longer stay on H4 status.

jamesthomas Posted September 15, 2015 Author Report Posted September 15, 2015 i was on student status before but my H1 got denied so i married to my girl fren and left the country. Then again on H4 visa i came back to USA. So if i file for divorce now i'll b out of status once divorce is finalised and what about my F1 conversion. I really don't understand what to do.

As rahul412 mentioned if your COS to F1 is in process you are in legal status in US.
