Suryavanshi Posted September 14, 2015 Report Posted September 14, 2015 Hi My name is Surya and I am currently on F1 visa status (OPT cap gap Extension). I got my H1b visa approved this year and have the H1b approved receipt with me. My H1b visa status will kicking from Oct 1st 2015. I am currently employed with a company ABCD (that filed my Visa) and working for a client XYZ. Currently I've been working for the client XYZ for about 6 months now and they are very happy with my work. They have offered a fulltime position for the role that I am currently in. Now, I've requested them to extend my the visa transfer until Dec 2015. I just want to know if there were any hiccups or fine lines I am missing for my visa transfer. I don't want my current employer to be notified for this. The client XYZ has agreed to it and will start my employer visa transfer in Dec2015. I also wanted to know if there's any time frame before I can have the visa transfer. I've all the paystubs from my current employers(ABCD). I look forward to hearing from you soon in this matter. Thanks and Best Regards, Surya.
jairichi Posted September 14, 2015 Report Posted September 14, 2015 A H1B transfer can be initiated only after Oct 1st. You will need to work for H1B employer ABCD and after that XYZ can initiate transfer.
payaldhadge Posted September 15, 2015 Report Posted September 15, 2015 Hello,I am currently employed at company A (past 1 year) . They had filed for my H1 which got approved this year, and my status will be active after 1st Oct 2015.But I want to change my job and transfer my H1 to company B.1. Do I need to work in Company A (on H1 status) before I transfer to company B ? If yes, then for how long?2. Do I need to stamp my visa before I start working for Company B? Thank YouPayal
jairichi Posted September 15, 2015 Report Posted September 15, 2015 1. Yes. At least work for a week. 2. If you are in US and employer B's I797 comes with an I94 there is no need for visa stamping to start work with B.
Suryavanshi Posted September 19, 2015 Author Report Posted September 19, 2015 A H1B transfer can be initiated only after Oct 1st. You will need to work for H1B employer ABCD and after that XYZ can initiate transfer. Thanks Jairichi for the reply, greatly appreciate it. I had one other question. I am currently working in a different MSA and need to file a new petition for different MSA, so was wondering if my client XYZ is filing employer visa change in Nov 2015. Do I still need to file amended petition with my current employer ABCD. I started working my client from June 1, 2015, so I've until Jan-15-2016 to file amended visa petition. Kindly advise me on this as well. Your advise in this matter is greatly appreciate and look forward to it. Thanks and Best Regards, Surya
