austomitahere Posted September 13, 2015 Report Posted September 13, 2015 Recently I have received my H1B petition ; the petition has validity period from July-15th-2015 to March-31-2017. I had applied in NON-CAP as I had earlier H1B visa which expired on Nov 2009. In my last H1B visa, I had spent total 3.5 years in US , now I was hoping they will give me my remaining 2.5 years back , but instead they only gave me around 1.6 years (July-15th-2015 to March-31-2017). My question is - can I apply for extension when my current VISA expires on March-31-2017? What are my options after March-31st 2017 ?What is the maximum duration of stay in US with H1B ? Do I have enough time to apply for I-140 and get it approved before Mar-31-2017 so that I can continue to work in US ? Here is my past US stay in H1B - Entry Date Exit Date Total Duration of stay 13-Mar-05 3-Feb-07 1.9 Years 24-Nov-07 1-Jun-09 1.52 Years Total Used 3.42 Years
jairichi Posted September 13, 2015 Report Posted September 13, 2015 6 years is the maximum allowed stay on H1B. Employer can file an extension for 1 more year after your current petition validity.
