rajcool111 Posted September 10, 2015 Report Share Posted September 10, 2015 Hello, I work full time with a company on H1B. My PERM is under process with them and it is now kept on hold for 6 months. As per my immigration attorney company can not file PERM labor certificate at least for 6 months from the day it announced layoffs to comply with DOL. Currently I have only 1.5 yrs left on my 6 yrs H1 and was wondering if my company can at least have the pre-work done like PWD and recruitment phase which takes aroung 4 to 5 months? Can the company start the recruitment phase within these 6 months have all pre-work done and then file/send actual PERM application on the date after 6 months from the day of layoffs? Please let me know what options I have as I have only 1.5 yrs left on 6 yrs completion. Thanks! Link to comment
