Bob_86 Posted September 10, 2015 Report Posted September 10, 2015 Hello Folks,My H1 is rejected on Employee-Employer relation not sufficiently evident. Its been more that 6 months I was working with the Receipt number with the denied employer. Now can I go back to the previous employer who had my approved H1 and was I 94 valid till 2016. And that project is still available at that same location and if he is willing to take me back what are the things that needs to be done by the employer, its been almost an year that I haven't been working for them? Should he apply an amendment or something. Please let me know.Appreciate any information provided.Thanks.
jairichi Posted September 10, 2015 Report Posted September 10, 2015 Yes, you can go back only after employer files a cap exempt H1B petition and gets it approved.
JoeF Posted September 10, 2015 Report Posted September 10, 2015 The previous employer was required to inform USCIS that you no longer work there. If you want to go back there, that employer would have to file a new H1 for you.

I have one employer filed an H1 petition with request for Extension of stay (I94) and Consular Processing with a new project. And at the same time, can I have another employer file H1 petition with some other project. ? Can both be Consular processing? If not what can be done? Appreciate your help. Thanks.

An employer can either ask for EOS or consular processing and not both. Yes, you can another employer file a H1B petition for you.

Does VISA stamping should be approved for doing so? Once you are outside US you are governed by the laws of the country you reside. It has nothing to do with US.
