EAD based on previous I140

Hi All,

 

I have an approved I140 from my previous employer. My PD is Nov 2009.

With the current employer, my PERM is pending with DOL . Current PERM was filed in Jan 2015.

 

Can I use the approved I140 from my previous employer to file my EAD with my current employer based on the new AOS rule that came yesterday or I do need a approved PERM and approved I140 from my current employer. Thanks.

You can, provided you can get a letter from I-140 employer that the job still exists based on which GC process was initiated.
