Hi,

Thanks in advance,

I-797 Validity -- 30 SEP 2015

I-94 Validity  -- 30 SEP 2015

H4 Dependent & I-94 Validity -- 30 SEP 2015

My H1B Extension has filed by Company A on 12 JUL 2015 in Non Premium Mode.

Currently i am having the new Receipt Number.

New employer i.e Company B asking me to join on Receipt Number.

My Queries:

  • can i join to new Employer i.e company B on Receipt Number, how much is that safe.
  • is H4 dependents can also stay with me
  • still i didn't resigned in company A, what happens if resigned in Company A, will the current employer ( Company A ) will withdraw the current extension.
  • How many days it will take to get my new I-797 if i stay with my Current Employer ( Company A )
  • With a valid Receipt Number, how many days i can stay legally in US
  • can i file a new extension in premium mode with the help of new Employer ( Company B ) after 30 SEP 2015

If any one can help in this regard, would be very helpful and also let me know if any one of my Query is wrong.

Regards,

Devi.

1. You are legally allowed to join new employer based on receipt notice but it is not safe.

2. Yes, provided an extension is filed for them.

3. Yes, they will withdraw that extension petition according to immigration law.

4. You are looking at October or November.

5. Can work till 240 days from your I94 expiry date.

6. Yes.

Hi,

Thanks in Advance..

I need full clarification on the 240 days stay after the VISA End date, is there any document available by the USCIS, stating that a worker or a consultant can stay up to 240 days from the I-94 Expiration.

Also, what if 240 days is completed, can we apply for PREMIUM Process after 240 days, and can i stay in the country after 240 days.. is that legal.
