yamaharx Posted September 10, 2015 Report Posted September 10, 2015 Hi Guys,I have a pending I140 from current employer with USCIS received date of oct 21 2014. my lawyer said i could go ahead with concurrent filing since my PD is current (140 porting from ex employer). should i go for filing of 485 to make it concurrent filing or should I upgrade the I-140 to premium process then file 485. i am asking this for the following reasons1. if i go ahead with filing of 485 and for some reason 140 gets denied, would that inundate the whole process and i lose the money paid to lawyer.please share your thoughts
pingpong Posted September 16, 2015 Report Posted September 16, 2015 Why do you think your I-140 would be denied. Unless your employer is involved in some fraudulent practice you should be good. I-485, usually takes at least 3-4 months to be processed, your I -140 should be processed before that. i see your I-140 is pending for long. You can contact USCIS and ask them to see what is holding it up for so long.
