Acceptance Cut-Off Date for Eb3

Hi

 

My husband is on H1B and he already filed his I 485 and had EAD under Eb3 . we got married after his I485 is filed so my name is not added in his file .But according to this new Visa bulletin if Acceptance Cut-off date for Eb3 move and his priority date become current then can i add my name in his file? Or we need  wait for final action date to add my name in his I 485 file ?

 

 

So only concern is when can i add my name in my husband's I 485 file ( Acceptance cut offf date  OR Final action date ) which date we need to follow to add my name?

You are not "added" to the I-485.

When the PD becomes current, you can file your own I-485 as his dependent.

Again, you DON'T "add" your name!

When the PD is current, i.e., when the PD is BEFORE the acceptance cut off date, you can file an I-485 as your spouse's dependent.

Again, you are not "added" anywhere. You file an I-485 when the PD is current.
