Hello,

 

I have few questions on setting up a new staffing firm while on H4 EAD

 

1) Can i open an S corp? do you need to have GC / Citizenship to open S corp?

 

2) I know i can recruit people for the firm, but can i sponsor H1B for others?

An S-Corp requires that all shareholders are Permanent Residents or US citizens.

And why do you want to start a low-margin company? There are lots of other venues which have way higher profit margins than the cut-throat IT consulting market.

With the kind of questions you are asking, your company likely wouldn't last a year...

For filing H1 petitions, the company would have to have enough money and income to be able to pay the salaries of the people on H1.
