Can I change company in India with an expired H1B and then renew from new company?

Hello,

 

I am currently working in the USA and employed by a reputed IT consulting company. My first 3 years of H1b will be expired on 04-Oct-2015. I want to go back to India in October and spend some time with my parents. After some time can I again ask my employer to renew my visa as 3 more years are pending with the same petition?

Also during the stay in India if I switch to another company can the new company legally transfer my petition (which will be expired by then as the current petition is valid till 04-Oct-2015) and file/renew cap exempt visa any time ?

 

Please answer to my questions, as based on that I will take my decision?
