msunny Posted September 8, 2015 Report Share Posted September 8, 2015 I stay in India. My company will file for my L-1 A visa shortly. I have a child I adopted 3 years back, in India. Is the L-2 dependent visa application for adopted child same as for a biological child. Or are there any additional forms etc to be filled up for an adopted child. Thanks Link to comment

TTN Posted September 8, 2015 Report Share Posted September 8, 2015 Hi msunny, Does your Child have a passport with your name in Father's name section? There should be evidence of the child being your dependent through Father - Child relationship. So I think there are no extra forms that you will need to fill up but please make sure to carry proof of relationship and adoption papers when going for interview. Please read the below details; "A petition may be submitted on behalf of an adopted child or son or daughter by a United States citizen or lawful permanent resident if the adoption took place before the beneficiary's sixteenth birthday, and if the child has been in the legal custody of the adopting parent or parents and has resided with the adopting parent or parents for at least two years. A copy of the adoption decree, issued by the civil authorities, must accompany the petition. " Unless there are no legal objections by Indian agencies there should not be any extra forms that needs to be filled for the Child to get the visa. The rule you mentioned applies to a US citizen and lawful permanent resident. Does a non-immigrant visa applicant fall in either of these 2 categories. Also, for the adopted child, do I fill up the routine DS 160 (I don't know if the form specifically requires me to mention adopted status) and carry the documents for interview. Link to comment
