I have 2 un used H1B approved and stamped visas , one was valid from 2001 to 2003 and the 2nd one was valid from 2003 to 2006. I was in USA on 2nd H1B visa for 6 months. Can I now move to a new company in USA by activating any of these H1B visas under Cap Exempt and status change option ( L1A to H1 B) ? What would be the process for this? Am I eligible to CAP Exempt with these old visas?
jairichi Posted September 6, 2015 Report Posted September 6, 2015 Yes, you are cap exempt provided you have not reached 6 years of stay in US on H1B and L1A. New employer files a cap exempt H1B petition with COS.
