rahulrao Posted September 2, 2015 Report Posted September 2, 2015 Hi, I moved from company A (consulting firm) to company B (Full time)in September 2013. Currently I do have I 140 approvals from my current company and previous company also. My priority date is October 2010 - EB2. Now I have 3 month contract to hire opportunity through Company A. This project will start in January 2016. Since my I 140 with company A is still valid, I am planning to move to Company A and convert to full time with client after initial 3 month contract period. My question is - what if dates become current sometime mid of next year. Once I convert to full time after 3 month contract with company A, I guess it will take anywhere between 8months to 1 year minimum to get I 140 with new company. What if dates become current in between this process. I am not sure if company A still willing to sponsor my GC at that time. Appreciate your help, thanks.
jairichi Posted September 3, 2015 Report Posted September 3, 2015 Stay away from consulting firms. If company A is not interested to hire you and they still have an active I-140 I would think it will be construed as immigration fraud. If days become current you can file I-1485 but if company A does not have that position available I believe you are in trouble. Check with an attorney.

Once your GC gets approved you are expected to work for GC filed employer. As I said before talk to an attorney.
