Later I got denial notice on my petition couple of days back . So I want to open my case (Motion to re-open) again as early as. 1) Can I legally be in USA till MTR get resolved ? If yes what be my visa status during this time period and how long I can be? If No what would be my other options to stay legally in USA? 2) Can I apply for h1b transfer or can I file for another h1b petition with same employer during MTR period? 3) Can I enrolled into university and make NEW SEVIS active to make my stay legal .
jairichi Posted August 31, 2015 Report Posted August 31, 2015 1. Not on H1B but on any other status like H4 or B2. 2. Yes, but you cannot stay till a decision is made on that petition. 3. That is impossible as school admissions for fall is long over. Reason for denial?
