amistad Posted August 25, 2015 Report Posted August 25, 2015 Hi, My wife is currently working during her F1 OPT which is valid till October 6, 2015. We had applied for H4 and EAD concurrently last month and we got to learn from our attorney that both have been approved on Aug 19 and have been mailed to us today. The date on EAD if from Oct 1, 2015. So my question is , 1. Can my spouse continue her employment without taking a break till Oct 1? As far as I know, as long as you are properly maintaining your F1 status, you can continue your F-1 and OPT until the change of status is approved. Depending on when the OPT expires and when the H-4 EAD is filed, it may be possible to continue working without interruption. Since OPT is still valid there shouldn't be any problem in this case right ? 2. Now that the new H4 COS is done , should we get a new I-94 as her original I-94 date was till October of this year ? Hope someone has some insight into this.
jairichi Posted August 26, 2015 Report Posted August 26, 2015 1. If her COS to H4 is approved then she has to stop working immediately. Check the validity date of that. 2. Check her H4 approval notice for I 94.
