Had approved H1B from a consultant from last year i.e. 2014 but couldn't join due to not getting stable client(s) in Oct 2014. This 2014 H1B got revoked by original petitioner few months ago. But now that I got offer from leading stable company, can the new sponsoring company file for H1B without subjecting to CAP i..e can this new company file for H1B transfer using old 2014 revoked H1B petition? PS: please note that I did do leapfrog as suggested by local lawyer/law firm i.e. went out of country on Sept 30th 2014 to Mexco and reentered US with same previous L1A petition on Oct 2nd 2014 and since then continuing on L1A here in US. Please let me know whether I can go for L1A to H1B transfer using revoked H1B petition with new sponsor? Thanks in advance.
jairichi Posted August 24, 2015 Report Posted August 24, 2015 Yes, you are cap exempt. You are eligible for 6 years - time spent in US on L1A status. You are looking at 2 more years.

Can the new sponsoring company file my Green Card in EB1 category on H1B? PS: Have overall 18+ years of IT experience & been in Managerial role for > 10 Years.

Yes, if your employer has a job that qualifies for EB1 and you meet all that criteria.
