MS_Neuro
If I am currently on a O-1 visa and my I-140 (through EB2 process) is approved, would I be eligible for 3 year H-1b extensions? My specific case is I was in H-1b for 5 years. In my sixth year of H-1b I moved to O-1 visa. In the first year of my O-1 visa my I-140 was approved (I did a EB-2 process through my employer). Am I eligible for 3 year H-1 b extensions even though I am in a O-1 visa? Thank you so much! Link to comment
jairichi
Employer has to file a cap exempt H1B petition based on approved I-140. Link to comment
