Before my attorney cud respond back on that, I got my GC through my husbands I-485 application. My attorney responded back to USCIS accordingly sending my current Green card and approved I-485 . Now since I got derivative GC and while USCIS is yet to close my RFE case, can I resign from my current employers office and join some other employer on W2. Thanks, Archana. Link to comment

Attorney_15 Posted September 2, 2015 Report Share Posted September 2, 2015 A dependent Green Card recipient can work or not; only the primary Green Card holder (based on employment) has a duty to work in the job offered or AC21 job. The employer here might want to respond with a copy of the GC to explain that the H1B is moot because the beneficiary is a lawful permanent resident. Link to comment
