Transferring from a non-profit cap-exempt H1-B job to for-profit employer

Hello members,

 

I am currently working as a reserach engineer in a university on a cap-exempted H1B visa after completing my M.S. This is my fourth year of H1B and I have never been counted against cap.

 

Due to issues at work and better oppurtunities I am planning to make a move to the private sector soon. Based on many threads in the forum and my understanding of the rules I have the following plan in my mind :

 

  1. Find a consultacy  to sponsor a cap H1-B when the window opens next year in Apr-2016. 
  2. If my H1B pettition is approved my understanding is I can work for my original sponsor from Oct-2016
  3. Meanwhile, I want to wait for an oppurtunity with some other employer than my original sponsor while staying in  university job. If I find another employer my understanding is they  should be able to apply for a new H1B without being restricted by the cap.

Please let me know if I am thinking on right terms to move from a university job to a for-profit employer.

I am planning  to make it easy to move to an employer of my choice by getting a cap-subject H1B approved. 

 

To get a cap-subject H1 approved, you need to find the "employer of your choice" first.

Trying to get an H1 through some shady consulting company won't work. That train has long ago left the station.
