Deepanshu Posted August 11, 2015 Report Posted August 11, 2015 Hi My spouse is working as consultant for a client for last 6 years. Her client is in Denver CO and we are in NJ for last 6 years. Her H1B company is also in NJ. Client is now offering her full time job while allowing WFH and willing to do H1B Transfer (She has an approved I140 for her H1B beyond 6 years). Wanted to know : 1) If there are any concerns for getting full time on Client H1B where client location is in Denver while she works from NJ? 2) What should we mention in her location of work in her H1B petition. 3)For which state her state taxes be deducted? NJ or Denver CO? Thanks Satyan

JoeF Posted August 12, 2015 Report Posted August 12, 2015 Maybe you shouldn't use abbreviations like WFH. Most people don't know what it means. You can write it out, you are not charged by the letter... Her workplace, i.e., her home, would be the work location to be listed on the LCA. As for taxes, that depends on the state. She may have to pay taxes in both states. Consult with a good CPA.
