shellyd Posted August 5, 2015 Report Posted August 5, 2015 Dear friends, I am on the 6th year of H1B and have got I-140 approved. My visa is expiring in the next 2 months and my employer hasn't filed for extension yet, since they aren't able to find a new client yet. Is it legal if I am able to find another employer who can transfer my visa and thus extend further? Since the time left on my current visa is very less, will that be a point for USCIS to deny the H1B transfer? Hope someone who have gone through my current situation would be able to give me a clear picture. Thank you
jairichi Posted August 6, 2015 Report Posted August 6, 2015 Your employer has time till the end of your I94 validity to file a cap exempt H1B petition and get a receipt.
