I-485 RFE and Outside of USA

Hello there,

I received RFE on my I-485 (EB3) with PD April 2004. Here are the details asked in RFE:

1. Employment verification letter

2. Proof of continuous employment

3. Medical records

 

I am currently in India and do not have a valid visa / AP now. My H1B renewal is in process now, but may take sometime to get that.

 

So my question is:

1. EVL - I will get from my employer - I am working for the same employer from past 11 years

 

2. Proof of continuous employment - I do not have valid H1 visa now and my AP got expired and I am in India now. I do not have continuous authorization. Will this be a problem? While I was in USA, I had maintained authorization correctly.

 

3. Medicals - can I take this from India?

 

Pls suggest if I can respond to the RFE from India? Request for help.

Your AOS is deemed denied since you left without getting AP. You can opt for CP if your employer will allow it.
