manavshah33 Posted August 5, 2015 Report Posted August 5, 2015 Hi, I have been laid of from my company recently while on h1b. I doubt i will bre able to find job within 30 days after my last day at work. Planing to move to f1 and enroll for studies in university. Is it safe to move to F1 for now and again apply for COS to h1b once I get new job? Or whats the best option apart from going to F1 to maintain a valid visa status.
JoeF Posted August 5, 2015 Report Posted August 5, 2015 You can't just "move to F1". Universities have application deadlines, and the application deadlines for Fall are long over. And you don't have "30 days", either. You are out of status from the day of layoff. You will have to leave the country. The employer has to pay fr your flight, by law. You can look for a new employer from abroad.
jairichi Posted August 5, 2015 Report Posted August 5, 2015 F1 for this fall semester is long over. Apply for a COS to B2 and this will help you to remain in US and look for a job for sometime.
jairichi Posted August 5, 2015 Report Posted August 5, 2015 I am sorry not F1 but admission for this fall semester is over.
rahul412 Posted August 5, 2015 Report Posted August 5, 2015 No its not safe to go back to F1,in fact you can't go back to F1 at this time since the admissions are closed for fall. F1 is not a option, so forget about F1. Either file COS to B2 and start looking for jobs or leave US.
