ssba Posted August 4, 2015 Report Posted August 4, 2015 I got RFE on my Amendment filing of current project. My current project is going to end very shortly and i have job offer at new client with same employer. 1.Can i file LCA and amendment for new client without answering to Amendment RFE on current client (i have time to answer RFE)? 2 Or do i need to answer RFE get Amendment approved on current client and then file new LCA and Amendment on New client where i have job offer? 3 What if my Amendment gets denied? Can i file new LCA and Amendment on New client where i have job offer?
jairichi Posted August 5, 2015 Report Posted August 5, 2015 Response to RFE is required or it will be considered denied. Employer can file a new LCA & amendment for new client.
ssba Posted August 5, 2015 Author Report Posted August 5, 2015 Thank you for your reply. I will respond to RFE. As i have job offer at new client 1. can i simultaneously apply for new LCA and Amendment on new client when my RFE response decision is in progress? or Do i need to get RFE response decision from USCIS before joining new client and filing amendment for new client? 2. If Amendment is denied after responding to RFE, Can i still apply new LCA and Amendment on new client as i have H1B validity till 2017. 3. Want to confirm what is situation of my case if Amendment is denied ( I have H1B Validity till 2017) thank u

Since you are no longer working for the client for which H1B petition was filed and approved you will be considered out of status from the date of denial of amendment.
