I am on H1-B since 2004 and have gone through stampings twice (2007 and 2011) and am palnning for another time this year. Both of these cases have been expunged and I do not have anything else on my record. 2007 stamping was quick but last time in 2011 I had to go through medical etc and took approx two months because I did not have documents on me and had to get them out of court. My priority date is still appox. 3 years away so I will need to make a trip to visit my parents and cannot avoid it and with their age and health condition I do not prefer for them to travel any more. Question: Would it be the same process and I will need to go through medical etc or will it be better becasue last time I was issued a visa and it has been over a decade and record since then is clean? All my well wishers who want to show me the mirror about drinking and driving, please do not invest your time beacause I have got my lesson and have been sober since last 11 years and am happily maried have a beautiful kid. I would recommend that you cover your bases with a Lawyer, maybe the firm of Murthy. State Expungement has no protection from federal agencies. Since you had got visas inspite of 2 arrests I would expect no trouble. Link to comment
