Due to some recent legal issues between them and DHS and publications in the media, I am transferring my H1B to another employer. My transfer petition was sent on June the 5th. We received a receipt as well. It was upgraded to premium processing on July 15th or 16th. The only mistake I made was starting my pay roll with the new employer before the transfer is approved. However, company A doesn’t know that I moved yet. I have been telling a few reasons to my current employer for taking off for a month or so. What options do I have left if my H1B transfer is not approved? Do I have time to apply with another employer if the transfer is denied? Will I have 15-30 days time period to do so? Do you have any general recommendations to fool proof myself from the mistake I made? will I be required to go for stamping outside US? Can I go back to my old employer as long as the H1B is not revoked? I have a client letter, pay stubs, and all other documents with my transfer petition. So my attorney has resent it. Appreciate if any seniors in the forum could help me save against my mistake. Link to comment
