H4 EAD - Recd RFE for one letter difference in name in Marr Cert

Hi,

 

I received RFE for my H4 EAD (I-765) form - it says "You submitted a photocopy of a marriage certificate showing your name as P,Sairbarathi. The spelling of your name is different from the  name on your Application for Employment Authorization (I-765). Please submit evidence of your true name."

 

VSC is reading my name as above but there is no "r" after "Sai" in the certificate.

 

Here P is actually my maiden name (my sur name before marriage).

 

My name on my passport, visa, h4, forms etc is Saibharathi Muddapu.

 

Here I see there is a letter "h" missing on certificate name as it says P. Sai Barathi.

 

Could you help me provide info on how to respond to this RFE.

Get your marriage certificate corrected and respond to RFE.

Not sure how much time it may take to get the correction done on the marriage certificate. It was taken in 2004. 

 

As there is only one letter "h" is missing in the name on marriage certificate, can I respond by submitting self Affidavit with notarization specifying the name belong to me and also provide additional supporting documents like Indian Driving License, Wedding card, kids birth certificates...?

You can try but nothing is guaranteed. Talk to an immigration attorney.
