H1b-H4 COS

Hello All,

 

My spouse filed for H1B - H4 COS in US in January'15. But in the month of April we went to India  & got her H4 visa stamped. 

 

The EAC # attached to the H4 COS in US still shows as "Case Received". I understand that this should have been abandoned. What communication do I receive, if any?

 

Not sure what I need to do.

 

Please help.

If you don't mind could you please tell me if they asked any questions about her H1 & pay-stubs at H4 visa interview? my wife is also in the same situation, she has converted her status from H4 to H1 effective 11/2014 but she could not find any job, so no pay stubs, she went to India last week and planning to get H4 visa stamp.

Your quick response and any guidance regarding this matter is highly appreciated.

Your spouse needs a copy of your I797 and marriage certificate.

Ask your spouse to file a complaint against employer with DOL. This will get her salary dues from Nov 2014 till her exit from US as by law employer has to pay her if she is on H1B whether a job is available or not.
