I am on a H1B visa, I have valid I797 till another 1.5yrs, last year in November 2014 I moved to another location from IL to MN. For this, during that time I even got a new LCA for this new location change. Now my porblem is with the new location change Amendment that came in April 2015 this year. I have planned visit to India this September 2015 during which i need to go for Stamping as my visa on Passport is expired. Now that i have filled my DS160 and submitted for my employer for review, my employer comes back now saying that a new amendment need to filed for me as my location has changed and my I-129 still has my old location. This is frustrating as I have told about this now after I have planned my vacation and have already booked my travel. But lately I learnt from my friend that their is a new process in amendment which came in on July21st 2015(link below) that people who moved/relocated on/before April 19th 2015 need not have to mandatorily file the amendment(but need to file before Jan 2016). I know there is a possibility of Premium processing but my employer wont. So is it possible i travel to india and go for stamping without the amendment(I-129) and the existing new LCA? Is the new proccess amendment that came 21st July 2015 allow me to travel india without the new amendment(i-129)? jairichi Posted July 26, 2015 Report Posted July 26, 2015 This statement is by USCIS not by DOS under which US consulate falls. I think a visa stamping might not be guaranteed without an amendment approval.
