bs.sheetal
Hi, My current employer has applied for my I-140 and it is being processed. It have not yet been approved. There is a chance that I may get laid off. What are my options after layoff ? Is there a possibility that my I-140 will get processed even after my layoff and I can carry it over to new employer ? Will my current employer send a revocation notice for my I140 after layoff ? The I140 processing is going on for close to 4 months now. I could not do premium processing because labor department did not send right documents to my lawyers after my PERM approval Do I have to start my GC processing from the start in new Employer ? Thanks Link to comment
JoeF
An I-140 can nver be "carried over to a new employer." It is always employer-specific. The GC process would have to start over from scratch with a new employer. The only thing that is possible is to reuse the PD if the I-140 is approved. Link to comment
