How earliest can the H1b be transferred after first activation in October?

Hello Mister,

My h1b has been approved in premium process. I have another offer for job in October ish.

My current employer says I cannot transfer the H1b until at least 3 months or 3 paychecks after H1b is active...

My employer has my approval notice for H1b and I think he might be hesitant to give me the originals. I should be having the original approval receipt right? Can he do that?
