The base salary offered is lower than prevailing wage but the bonus offered if goals are reached could bring me to prevailing wage and higher. Can the employer do that? Should I request that the base salary equals prevailing wage because bonus is not guaranted (depends on goals)? thx

Attorney_21 Posted July 24, 2015 Report Posted July 24, 2015 To be counted as part of the wage for "prevailing wage" purposes any bonus must be "guaranteed" and "non-discretionary". In other words, if there is a chance you won't get the bonus, it doesn't count towards meeting the PW.
