Does Priority Date depends on Country of citizenship or birth Country. I was born in Pakistan then family moved to India. Got Indian citizenship ( Indian Passport ) in 2006. Now, I work in USA company on H1B.. My Company will file GC in EB3. Will my priority date be same as Indian applicant ( Long Waiting ) or it will be based on Pakistan ( Current 0r few months waiting) Thanks, Link to comment

Attorney_21 Posted July 23, 2015 Report Share Posted July 23, 2015 Priority Date "Chargeability" is normally based on country of birth (NOT citizenship). Acquiring another country's citizenship will not normally change your chargeability. There are some limited exceptions (i.e. children of diplomats, or children born in a country where their parents did not reside and were not born in). If your parents resided in Pakistan when you were born then you are most likely subject to the more-favorable Pakistani dates, but talk to an attorney about your individual circumstances to confirm this. Path2usa Posted July 24, 2015 Author Report Share Posted July 24, 2015 @Attorney_21 -- Yes, my parents were citizens of Pakistan. @pontevecchio -- I don't have Pakistan's Birth Certificate but my passport has details on it. ( Place of Birth ). Also, I have Indian Citizenship Certificate which mentions my Country of birth. Thanks, Link to comment
