H4 to H1 Status change still pending

Hi,

i am currently on H4 Visa. in 2014 april employer A applied H1b petition for me. FInaly it got approved on Dec 2014. Since then my employer A is not provided me the H1B approved copy or any documents.

1)My question is what is my current status

2)If i dont want to employ with Employer A what should i do?

3)what should i do to apply H4-EAD?

1. If approved as COS then you are on H1B status. In that case if you are not paid you are out of status. You will need to file a complaint with DOL to get your salary dues and ability to move to a new employer who can file a cap exempt H1B petition.

3. H4 EAD is not for everyone. What is the situation of GC process with your spouse?

Was your H1 filed along with COS? If yes then you are in deep trouble.
