H1B sabbatical in India for 6-8 months

Hi, 

 

I am H1B and working for a US based stuffing company. I am planning to go to India for long duration after my current project works. Since I will be on leave there is no pay during that period. My current H1B is valid for another 2 years. 

 

1. Is there any issue with this. Will there be any problem if I go for stamping after 6-7 months with no pay ( I will be in India in that period).

 

2. Can I come back once I am done with personal work and want to return to US. 

I am wondering if spending 8 months in India without pay will be an issue in Future.

When you are outside the US you are no longer on H1, so you are safe.

Thanks for your responses. I have heard some issues can arise if they ask for latest pay stub. 

Is it alright if we are on leave for 6-8 months and pay stubs are that much old and we have not got paid in entire period in India. (my comp is not present in India).

What you heard is a rumour.
