H1 approved but applying for L1B extension

Hi,

 

I have a few questions. I am working on L1B visa (which expires this November) with company A and my I94 is valid till March 2017. I have also applied for H1B visa through company B and which got approved. Now my company(company A) is asking me to file for my L1B extension.

 

Shall I move forward with the extension. Will that have any impact on my approved H1B status.

 

Can I work with company B on H1 from October 2015 or do I need to work with company A on L1B?

 

I am a little bit confused. Please advise what should be the right approach.

If L1 extension gets approved after Oct 1st as per last action rule you need to stop working for H1B employer & join L1 employer.

Thanks jairichi for your comments. So, in that case can I use my H1B later on when I want to resign from my current employer.

 

I have one more question. If I resign now and if my current employer revokes my L1 visa, will that have any impact on my status till October 1st. Because during this period(till Oct 1), I will not have any visa status. Will that have any impact on future GC application?

1. Yes. You will get only 6 years - time spent in U.S. on L1B status.

1. Yes. You will get only 6 years - time spent in U.S. on L1B status.

2. No impact as long as H1B petition is pending for approval. If approved before Oct you would have to exit US & enter with a valid H1B visa & I797
