Whats the Legal Wait Limit for H1B Transfer

I have below situation and wanted to know the correct option for me:

1>My Earlier Visa Denied with Company A on premium 

2>I Joined company B and they filed on Regular on Jan 2015.Got RFE replied to that as well.

and now my status shows Response to RFE recevied.

3> Its been almost 6 Months now for Visa processing now, Just remember something like you can't wait for Visa processing for more that 180 days i.e. 6 Months.

 So my questions are:

      a> How long should i wait for my Visa processing (Transfer)

      b>Is there any obligations that if you don't receive the updates by 180 days or so then you must leave US before that?

      c> Or can i wait long enough (6-9 months?) without any issues as its under process?

You attorney can contact USCIS to get a status on your case since you have been waiting too long.

 

Based on the outcome of the USCIS enquiry if your petition is still in pending status you should be ok. 

 

Another option you can try out is to have your application upgraded to Premium processing to get a faster result.

You have 240 days. But before that converting to premium may be the way. Talk to your Lawyer.
