H1 stamping with nearing passport expiration

hi,

 

Facts:

My passport is valid till Dec 2016. current visa/I-94 valid till march 2016.

Recently i did a H1 transfer  with company B, which was approved March 2018.

 

planing to go for stamping in Oct in India.

 

 

Question:

If i go for stamping with my current passport, will visa be issued till March 2018 or till passport expiration date i.e. Dec 2016?

 

Or should i apply for a fresh passport before stamping, i heard In India passport can only be renewed before 1 year of expiration. 

 

Will it be possible to renew my passport in USA itself before travelling to India, will Indian consulate accept passport renew application, as i have not entered 1 year before expiration.

no they dont accept passport renewal application before 1 year except you put your passport renewal application in any other special category like addition of spouse name after marriage, or name change (mostly for women after marriage).

But I think most of the lawyers advise to go for visa stamping with passport with atleast 6 month or more validity left, you are most probably in good shape in that case (please dont relay soley on my advise). Still you can double check with your company lawer who normally can advise you on some basic outline of documents and basic requirement when you are going for stamping. Good luck !

Hi,

 

I have approved H-4 till Sept 2018

 

passport expiry July 2016 ( 7 months from arrival date after )

 

going to India for stamping (drop box eligible )  on Nov 10th 2015

 

coming back to USA on Dec 18th 2015

 

need help for.

 

1. will there be any issue in stamping or will it affect of stamping end date.

 

2. If I get it stamped and @ port of entry I-94 given till July 2016 then what will be the process for extension of I-94 after getting new passport

 

3. do i need to step out of country after getting new passport

 

appreciate your help.
