sri2013 Posted July 15, 2015 Report Share Posted July 15, 2015 My case: All Visa cases L1B, I-140 & H1B are applied through Employer A -> I completed L1B visa - 5 Years from 2010 to 2015 (June/2015, L1B MAX Out completed) .Currently I am out of US. -> Now my H1B Petition is approved on May/2015 & got I797 up to July/2016. ( I am planning to go for Stamping later this year Oct/2015 & travel to US on Nov) -> Also I got my I-140 approved on June/2015. -> On Oct/2015, Change of status from L1B to H1B & H1B Max out is July/2016. -> Based on my current I-140 approval, i will extend my H1B Visa from my current employer A. My Question : 1) After reaching US on Nov/2015 & apply for H1B extension (with I-140 approved status) on Employer A . I am planning to quit the employer A. I know my current Employer A will revoke my I-140 if i quit the job. IF get extension for 3 Years, then i can switch new Employer B and i have time to initiate new PERM/I-140 . a) In case if I get H1 extension for 1 Year then what is the option available for me to switch company ? b) Even Employer A withdraw I140 whether new Employer B have efficient time to start PERM approval within a Year ? 2) With Employer A, my H1B extension is approved for 3 Years / 1 Year. Then i quit the job. a) New Employer B will initiate the transfer process whether transfer will get new H1B extension 3 Years / 1 Year based on new Employer B documentation(client letter/SOW) or I will retain the same H1 extension years which i got from my Employer A? 3) Currently I got approved I140 & receipt of I140 - soft copy from my employer A. Whether its sufficient to do transfer or do we need original approved copy ? 4) After getting H1B stamping this Nov & travel to US. Can i switch Employer with out applying extension , what is the option available ? Link to comment
