murlitraveler Posted July 15, 2015 Report Posted July 15, 2015 Friends - Need some help here please. I applied for my parents visitor visa extension (I539) however they had to leave before the I94 expiry. I sent the withdrawal letter to USCIS indicating that they have already left the country along with the supporting documents and requested to not process I539 since it is no longer required. USCIS received this letter and sent a RFE that my parents should be signing this withdrawal letter and not me...however I never received this RFE. In fact I received this RFE and I539 decision (abandoned and denied per 8 CFR 103.2(b)(13) on the same day. My questions are - 1. Does this denial impact my parents visitor visa even if they left US before I94 expiry? 2. If it does, what are my options to appeal this RFE and how should I go about it? Please help. Your response is greatly appreciated. Thank you.
JoeF Posted July 15, 2015 Report Posted July 15, 2015 If they left before the I-94 expired they are fine.
pontevecchio Posted July 15, 2015 Report Posted July 15, 2015 Just move on. If they left before I94 expiry they will face no trouble for future visits. They should retain travel details with them.
