H1B Visa Transfer Processing

Hi,

 

Currently i am working for the Employer 'X' and i got an offer from Employer 'Y' . So i am planning to switch my Employer from 'X' to 'Y'

 

As per current situation,  we can not apply  Premium processing for my H1B Visa Transfer.  And if we apply by Normal processing it will take 4 to 8 weeks to get it approved. 

 

But Employer 'Y' is saying, once you get H1B Visa Transfer Receipt Number, then you can resign from the Employer 'X' and join at Employer 'Y'. And we (Employer 'Y') will run your payroll. 

 

You no need to wait for Approval.

 

Is it true?. Will it create any problem if i get any RFE?. 

 

Can i travel to India with H1B Visa Transfer Receipt Number (while my H1B Visa Transfer application in processing/review state)?

 

Could you please help with above doubts.

It is true. But, it will be wise to put in your resignation papers with current employer after H1B approval with new employer.

You can travel to India but you cannot enter without H1B approval.

USCIS started Premium processing for H1.

Yes you can start working with receipt number, but if your H1 transfer is denied then you will be in trouble. So wait till H1 is approved.

If current employer revokes your H1B petition & new employer's H1B is denied you will be in trouble.

I am currently working with employer A  and my project is ending in October. I applied for H1 transfer to employer B on July 8th and still waiting on the receipt . Any one applied around the same time and waiting for the receipt .

 

1) if I get the receipt number can I switch to my new employer and start working with the client

 

2) Can I be with my old employer A and work until October even though I get the receipt number with the new employer B and transfer after the H1 process has been done
