IWP eligibility

Hi,

I have a new 3 yr H1b approval.

1. My last h1b visa stamp issued in 2012, expired on 2nd Sep 2014 (it is less than 12 months from expiration).

2. I have a new passport, new passport number; old passport is expiring next month.

3. My employer is the same, but petition name is changed on H1b for different business unit. Does it matter?

I am uncertain about point 2 and 3. Am I clear for IWP?

What else I shall be careful of to get stamped successfully?

Thank you

That is no longer the criteria.

I read that. Do they specifically mention anywhere in news/updates/notifications that petitioner condition is removed? Or has anyone gotten successfully done?

  • If I am applying for an H or L (individual) visa, my prior visa in the same class is still valid or expired within the last 12 months.

Vs

Earlier for long time, and even now the other consulate site says -

http://mumbai.usconsulate.gov/iwp2.html

  • Temporary workers on H1-B visas returning to work for the same petitioner where the visa is still valid or has expired within the last 12 months

Well, if that condition was there and removed from the eligibility criteria what is the normal take on that?

  • 2 weeks later...
