sam@1988
Hi, I have filed H1B for FY2016. I have done my Masters degree in USA and I am on my OPT extension. I was not selected in the initial lottery. I got a notice saying the LCA submitted with form I-129 was not properly signed. "All H1-B cap subjects petitions recieved at the California or Vermont service centres from April 1,2015 to April 7, 2015 were subject to a computer generated random selection process. USCIS recieved your petition during this filing period and reviewed it for acceptability and/ or required documents. USCIS does not consider the petition to be properly filed for the reason noted below. Therefore, USCIS has rejected the petition and is returning it to you. Please do not resubmit this petition as the H1B cap for FY16 closed on April 7, 2015. The LCA you submitted with form I-129 was not properly signed. " Can you tell me this means I was actually picked but rejected because LCA was not properly signed. If yes, Can I reopen my case? Thanks, Sam Link to comment
jairichi
Yes, the petition was selected in lottery. Not you but your employer can reopen the case. Link to comment
victor_26
Your attorneys can try to file for an appeal and see if that will help them to reconsider your case. Link to comment
