Our project is going to end in Nov15 and have no clue if client provides letter to me. 1) What can be done in this case to respond RFE? 2) Is client letter is mandatory? 3) Can I provide the all the details of new client? Your response is highly appreciated. -
JoeF Posted July 9, 2015 Report Posted July 9, 2015 A client letter is mandatory. And the employer should have known this, because it is nothing new. Does the employer have a lawyer? If not, they should get one. The RFE is the employer's responsibility. You need to stay out of that.
livliv Posted July 9, 2015 Report Posted July 9, 2015 Your employer has to take care of this, it is their petition. They have to show that a valid EE relationship exists between you and them. They also need to show that they have work available for you for the requested duration.

If client does not provide one then a letter from client that they do not provide a client letter. Also, other documents from client are to be submitted with respect to project. 3. If you do then H1B will be denied.

I got new assignment from new client for new US location. So 1) Can I submit new client documents? 2) I guess LCA will require. 3) What is proces to file H-1B amendment at this stage? 4) If new LCA takes time and it crosses RFE due date then will my Visa process denied? No 3. You cannot file H1 amendment at this stage. Amendment is filed only for approved petitions. It looks like this H1 is gone since your initial project mentioned in your H1 is no longer exists.Next time find a real employer not a consulting firm.

Thanks again for quick replies. Your H1B petition will be denied as that job is no longer available. Providing new client details will lead to direct denial.
