Hi Guys,

could you please advise on the below. 

 

1- My H1B has maxed out. i get extension based on my approved I140.  My current H1B is valid till may 2017. 

 

I got a offer from Company B, who is willing to file my H1B Transfer in Premium and expecting me to join once he gets the Receipt number. 

 

My Question is -

1- is H1B Transfer Premium processing on Hold till July 27? i checked the USCIS website, it just talks H1B Extension. but i see many thread around it and i get the mixed response. 

 

2.  If i join the Company B using the Receipt number and my current employer revokes my I140, will my transfer go through based on the fact that i had approved I140 when my H1B Transfer was filed. 

 

3. My Company B emoloyer says that now days Premium processing takes more than 1.5 months instead of 15 days. not sure how true this statement is.

Though you can join new employer based on receipt notice it is wise not to do so. You will be in trouble if new employer's H1B petition is denied and current employer revokes your H1B petition.

1. Let employer file in PP. If PP is suspended for the time the check for PP will be returned.

2. If I140 is revoked before your H1B transfer then if approved you will get H1B valid till May 2017.

3. PP is 15 calendar days.

1. If transfer includes extension of status PP is not available, if not then PP is available.

2. Likely not. But even if A sends the revocation letter, it will not be processed before transfer is processed. Once approved B will have until 2017 to get their own I-140/PERM.

3. With RFE it can take that long. Without RFE, 7 days for LCA, then a few days to get receipt and 15 days for PP.
